Facts
In a proceeding before an Italian court, Flaminio Costa argued that a provision of Italian law relevant to the proceeding violated the Treaty of Rome. The Italian court requested a preliminary ruling from the European Union Court of Justice, posing the question of to what extent community legislation takes priority over domestic legislation enacted in European Union (EU) member states.
