Facts
George Flamm (plaintiff) sued Emmanuel Van Nierop (defendant) for intentional infliction of mental distress. Flamm alleged that Van Nierop had engaged in a sustained and malicious harassment campaign against him by tailgating Flamm as he drove; walking closely beside, behind, or in front of Flamm as he walked down the street; running threateningly at Flamm when he was out in public; and prank calling Flamm’s home and place of business. Flamm asserted that Van Nierop’s conduct had caused such severe mental and emotional distress and sleeplessness that Flamm had been physically debilitated. Van Nierop moved to dismiss Flamm’s complaint, arguing that it failed to state a cause of action.
