Facts
Stephan Fleet (plaintiff) and Archie Simpson (plaintiff) were actors in the film The Legend of the White Horse. CBS, Inc. (defendant) purchased the rights before the film went into production. After filming began, a company that was not a party to the original production agreement stepped in to ensure completion. The company did not pay Fleet or Simpson their salaries. CBS released the film on video with a picture of Fleet on the box. Fleet and Simpson brought suit under the California Civil Code, alleging a right-of-publicity violation. The court granted summary judgment in favor of CBS. Fleet and Simpson appealed. The California Court of Appeal granted certiorari.
