Facts
Nancy Stillman’s (defendant) farm was foreclosed upon. The Fletchers (plaintiffs) purchased the farm at the foreclosure sale. The renter of the farm had planted soybean crops. At the time of the foreclosure sale there was a mature, unharvested soybean crop on the farmland. The Fletchers brought suit, claiming that they were entitled to the landlord’s share of the proceeds of the crop sale. Stillman argued that once a crop matured it no longer relied on the land and thus was constructively severed. As a result, according to Stillman, the soybean crop did not pass to the Fletchers at the foreclosure sale. The trial court found in favor of the Fletchers. Stillman appealed.
