Facts
Mark Fletcher (plaintiff) was an employee of Union Pacific Railroad Co. (UPRR) (defendant). Fletcher fell while working on a moving train. Fletcher sued UPRR under the Federal Employers’ Liability Act, claiming substantial and permanent injuries. The physician who examined Fletcher for UPRR found no signs of serious or permanent injury. Fletcher moved to compel production of any surveillance films UPRR took after Fletcher was injured. The films depicted Fletcher engaging in everyday activities on seven days two to 15 months after the accident. Fletcher maintained that the films would provide evidence of the extent of his injuries.
