Facts
Sun-Sentinel, Inc. (defendant) filed a good-cause petition in Palm Beach County, Florida, seeking access to confidential public records held by the Florida Department of Children and Families (DCF) (plaintiff). DCF was headquartered in Leon County but maintained a regional office in Palm Beach County, at which the records Sun-Sentinel sought were located. DCF moved to transfer Sun-Sentinel’s petition to Leon County, where DCF was headquartered, citing the home-venue privilege. The trial court denied DCF’s transfer petition, holding that the home-venue privilege was inapplicable because none of the public-policy reasons justifying the home-venue privilege applied to Sun-Sentinel’s petition. On appeal, the appellate court affirmed, holding that the trial court’s refusal to apply the home-venue privilege was an appropriate exercise of its discretion. DCF appealed to the Florida Supreme Court.
