Facts
The Sanford-Orlando Kennel Club, Inc. (plaintiff) operated a dog-racing track in Florida. Seminole Park & Fairgrounds, Inc. (defendant) was seeking to operate a harness-horse-racing track and had requested permits from the Florida State Racing Commission (defendant). The kennel club filed a lawsuit, seeking a declaratory judgment that Section 550.05 of the Florida statutes prohibited the issuance of a permit to a harness-horse-racing track within 100 miles of a dog-racing track. The trial court agreed with the kennel club and issued a declaratory judgment. Seminole Park & Fairgrounds appealed.
