Facts
The circuit court granted motions to dismiss in 46 cases charged under Section 893.13 of the Florida Comprehensive Drug Abuse Prevention and Control Act, finding that the act violated the due process clauses of the Florida and United States constitutions because it lacked a mens rea requirement. On appeal, the appellate court certified to the Florida Supreme Court the issue of whether the act was constitutional without a mens rea requirement.
