Facts
A female public-school student in the eighth grade, Nichole Force (plaintiff) was refused an opportunity to try out for the junior-high football team. Force’s mother (plaintiff) met twice with the board for the Pierce City School District (school district) (defendant), which voted unanimously to deny the request to allow a tryout although the board members all agreed that the female student would be a good football player and would have no safety issues while playing. The mother brought suit in district court on Force’s behalf, claiming that the board’s decision not to allow a tryout was based solely upon Force’s gender and that this sex-based determination violated equal-protection rights under the Fourteenth Amendment to the United States Constitution. The school district argued that the discriminatory means employed by the football program was substantially related to achieving the important government objective of maintaining athletic educational programs that are as safe for participants as possible. The mother sought an injunction preventing the school district from refusing to allow Force to try out for the junior-high football team.
