Facts
Lashawn Beasley (defendant) leased a townhome in a housing complex managed by Forest City Residential Management, Inc. (Forest City) (plaintiff) and subsidized by the Section 8 program administered by the United States Department of Housing and Urban Development (HUD). Beasley had a medical-marijuana card issued by the State of Michigan because she used marijuana to help her manage multiple-sclerosis symptoms. Beasley’s lease included a provision permitting Forest City to terminate the lease if Beasley engaged in drug-related criminal activity on the premises. Forest City filed a state-court complaint to terminate Beasley’s lease, and Beasley requested reasonable accommodation under the Fair Housing Act (FHA), a federal statute that prohibits disability-based discrimination in the rental of public housing. Forest City then dismissed the state-court case and filed suit in the United States District Court for the Eastern District of Michigan, seeking summary judgment.
