Facts
Forest Laboratories, Inc. (Forest) (plaintiff) made sweetener tablets and created a method to extend each tablet’s shelf life. This method included tempering the tablets in open containers with under 40 percent humidity for one to two days before packaging the items for sale. Pillsbury Co. (defendant) adopted this method for its own products with the modification of using closed containers. Forest sued Pillsbury for trade-secret misappropriation. The district court held in favor of Forest.
