Forshee v. Waterloo Industries, Inc.
United States Court of Appeals for the Eighth Circuit
178 F.3d 527 (1999)
- Written by Galina Abdel Aziz , JD
Facts
Melissa Forshee (plaintiff) sued Waterloo Industries, Inc. (defendant), alleging that she was discharged from her employment after she refused her supervisor’s demands for sexual favors. A jury returned a verdict in Forshee’s favor, awarding $10,369 in backpay damages, $9,631 in compensatory emotional-distress damages, and $14,733 in attorney’s fees. Forshee submitted a motion for attorney’s fees, which requested a $150 hourly rate for attorney Murrey Grider although his regular hourly rate was $100. The district court enhanced Grider’s hourly rate to $125 on a contingency basis. Waterloo appealed, arguing that the trial court abused its discretion by enhancing Grider’s hourly rate.
