Facts
Jonas Fouts (defendant) was convicted of aiding and abetting in a murder in the first degree and was sentenced to be hanged. The Ohio Supreme Court allowed a writ of error and stayed execution of the sentence. Among other errors, Fouts argued that the indictment was insufficient because it did not charge him with having a purpose or intent to kill.
