Fowler v. Lanning
Queen’s Bench
1 QB 426 (1959)
- Written by Mary Phelan D'Isa, JD
Facts
A writ was pleaded in a common-law court that alleged that on November 19, 1957, a shooter (defendant) at Corfe Castle in Dorset County shot and injured the victim (plaintiff) and caused the victim to suffer loss and damage. The shooter demurred (asked the court to dismiss the case for failure to properly allege a claim) and alleged that the writ failed to plead a proper claim because it failed to allege that the shooter acted negligently or willfully.
