Facts
Charles Fowler (defendant) and several others were preparing to rob a bank when Todd Horner, a state police officer, approached the men and asked them to identify themselves. Fowler shot and killed Horner. Fowler was convicted under the federal witness-tampering statute. The Court of Appeals for the Eleventh Circuit affirmed. Certiorari was granted.
