Facts
Fox News Network, LLC (plaintiff) filed a request under the Freedom of Information Act (FOIA) with the U.S. Department of the Treasury (defendant). Fox requested all agency records related to the government bailout of American Insurance Group and Citigroup, Inc. Treasury disclosed over 10,000 pages of documents, but withheld approximately 7,000 pages of documents based on the inter- or intra-agency communications exemption, the deliberative process exemption, the attorney-client privilege exemption, and the proprietary commercial or financial information exemption. Fox appealed to federal court. The United States District Court for the Southern District of New York ordered Treasury to file a Vaughn index. After a judicial conference, approximately 300 documents remained in dispute. Both parties moved for summary judgment.
