Frambach v. Dunihue
Florida District Court of Appeal
419 So. 2d 1115 (1982)

- Written by Alex Ruskell, JD
Facts
Stanley Dunihue (defendant) moved himself and his family into the home of Paul and Allene Frambach (plaintiffs). Dunihue and the Frambachs agreed to live together and share the costs of raising their families, which equaled 12 children between them. Both Dunihue and the Frambachs made financial contributions for bills, but Dunihue made several improvements to the home, and Allene ran the household and did the cooking. Nineteen years later, after the last Dunihue child had moved out, the Frambachs kicked Dunihue out of the home with 30 minutes notice. Dunihue argued that the Frambachs had promised that he could stay in the home for the remainder of his life. Dunihue sued, and the trial court awarded him a tenancy in common with the Frambachs in the property. The Frambachs appealed.
