Facts
Franca Ninni-Orasche (plaintiff) was an Italian citizen living in Austria. In 1995, several years after Ninni-Orasche moved to Austria, she worked as a waitress for two-and-a-half months and then failed to find further employment. In March 1996, Ninni-Orasche enrolled as a student at an Austrian University and applied for financial aid. Austria denied Ninni-Orasche’s request for financial aid. Ninni-Orasche sued, arguing that because she was a worker under European Union (EU) law, Ninni-Orasche was entitled to financial aid under an Austrian law that granted financial aid to foreign nationals to the extent that such foreign nationals had a right to be treated as Austrian nationals under EU law. The Austrian court requested a preliminary ruling on the definition of a worker under EU law from the European Union Court of Justice.
