Facts
A federal district court found that Bowman Transportation Co., Inc. (Bowman) (defendant), the defendant in a class-action lawsuit, had violated Title VII of the Civil Rights Act of 1964 by engaging in unlawful racial discrimination in refusing to hire a subclass of identifiable Black applicants for over-the-road truck driver positions (OTR applicants) (plaintiffs). Although the court awarded the OTR applicants a portion of the relief they had requested, it stopped short of awarding them seniority status retroactive to the date of discrimination. The OTR applicants appealed, and the court of appeals affirmed the district court’s denial of retroactive seniority status. The United States Supreme Court granted certiorari.
