Facts
The Free Speech Coalition (FSA) (plaintiffs) was a trade organization consisting of businesses that produced and distributed adult-themed material. After Congress passed the Child Pornography Prevention Act of 1996 (CPPA), the FSA filed suit alleging that the CPPA was unconstitutional under the First Amendment of the United States Constitution. The district court upheld the constitutionality of the CPPA, finding that it was content-neutral, not unconstitutionally vague or overbroad, and that it did not constitute an improper prior restraint of speech. The FSA then appealed the district court order.
