Facts
Morris County voters authorized the Morris City Freeholder Board (defendant) to use public funds to provide grants for historic preservation. Under the grant program, municipal governments, charitable organizations, and religious institutions could apply for grant funds for various construction projects to support the preservation of historical buildings, including churches. A number of active churches applied for and received grant funding for the preservation of their buildings in order to continue holding religious services in the buildings. A Morris County taxpayer and the Freedom from Religion Foundation (plaintiff) filed a lawsuit alleging that the grants violated the religious-aid clause of the New Jersey Constitution.
