Facts
Dr. Linda Freilich (plaintiff) had hospital privileges at Harford Memorial Hospital (hospital) (defendant). Freilich disagreed with the hospital over its decision to outsource quality assurance and oversight services for dialysis patients. Specifically, Freilich complained that the hospital’s decision led to an improper standard of care for these disabled patients. After Freilich voiced her complaint, the hospital terminated her hospital privileges. Subsequently, Freilich brought suit, contending that the hospital retaliated against her in violation of the Americans with Disabilities Act (ADA). The district court dismissed the case. Freilich appealed.
