Facts
Two French companies, Kali und Salz and Mitteldeutsche Kali sought to complete a horizontal merger, after which they would have a de facto monopoly in the potash market. The European Commission (commission) (defendant) approved the merger. Two more French companies, French Republic and Société commerciale des potasses et de l’azote (SCPA) and Entreprise miniere et chimique (EMC) (plaintiffs) appealed the decision to the European Union Court of Justice.
