Facts
There was a tragic aviation accident in South Vietnam in 1975. Some Vietnamese children (plaintiffs) were seriously injured and sued Lockheed Aircraft Corporation (defendant). During the litigation, the trial court granted partial summary judgment, pertaining to liability, to the children. The trial court also determined that the children were in need of immediate medical diagnostic testing and faced irreparable injury if the diagnostics were not done. The trial court entered an injunction requiring Lockheed to create a $450,000 fund to pay for these expenses. Lockheed appealed.
