Facts
In 1984, Laurence H. Frommhagen (plaintiff), a resident of Santa Cruz County, filed an in pro per suit against the Santa Cruz County Board of Supervisors (the board) and others (defendants) to invalidate service charges levied by the board in a number of county service areas for the 1984-1985 fiscal year. Following a two-day trial, the court rejected each of Frommhagen’s contentions and dismissed his suit. The dismissal was affirmed on appeal. In 1985, Frommhagen filed a second action against the board challenging the board’s service fees for fiscal year 1985-1986, asserting, with three alleged exceptions, the same allegations that he asserted in his first suit. The trial court sustained the board’s demurrer and dismissed the second action after finding that it was barred by res judicata. Frommhagen appealed and argued that his second action was not barred by either res judicata or collateral estoppel.
