Facts
The Federal Trade Commission (FTC) (plaintiff) commenced an investigation of the tobacco industry. In connection with the investigation, the FTC petitioned the district court to require American Tobacco Company (Company) (defendant) to produce documents sent between the Company and its wholesalers. The district court denied the petition.
