Facts
Staples, Inc., and Office Depot, Inc., (defendants) proposed a merger. The Federal Trade Commission (FTC) (plaintiff) sought an injunction to block it under the antitrust laws. FTC argued that the relevant market was a cluster market of large B-to-B customers spending more than $500,000 on office supplies annually. Staples and Office Depot countered that the relevant market should include all their customers and sales of ink, toner, and products beyond office supplies.
