Facts
Jerry Fukida (plaintiff) asked Hon/Hawaii Service and Repair (defendant) to repair his vehicle. Hon/Hawaii told Fukida that the vehicle had transmission problems. Fukida authorized Hon/Hawaii to install a rebuilt transmission but told Hon/Hawaii that he wanted to inspect the transmission before it was installed. However, Hon/Hawaii installed the transmission without informing Fukida as he requested, and Fukida refused to pay the bill. Hon/Hawaii told Fukida that it would keep the vehicle and charge him a daily storage fee. Fukida sued, seeking the return of his vehicle and loss-of-use damages for the cost of renting another vehicle while Hon/Hawaii had his vehicle. The trial court ruled in Fukida’s favor. Hon/Hawaii appealed, and the appeals court held that any loss-of-use damages were limited to the value of the vehicle. Fukida appealed to the Hawaii Supreme Court.
