G.C. v. State
Florida Court of Appeal
407 So. 2d 639 (1981)

- Written by Kelli Lanski, JD
Facts
G.C. (defendant), a juvenile, was charged with aiding and abetting attempted burglary. The state presented evidence that G.C. knew that a person called Delgado intended to burglarize an apartment, that G.C. followed Delgado to the apartment building, and that G.C. stood nearby and watched as Delgado removed glasses from the window of the apartment. The state argued that G.C. aided and abetted Delgado by acting as a lookout. G.C. was adjudicated delinquent as an aider and abettor and appealed, arguing that neither his presence at the scene of the crime nor knowledge that a crime was occurring was sufficient to attach criminal liability.
