Facts
The plaintiff, an insured employer (employer), had a fidelity insurance policy to protect himself against misappropriation of funds by his employees. The employer brought suit against his insurance company (defendant) to recover under this policy. At trial, he sought to introduce into evidence written and signed confessions of his employees admitting to embezzling his funds. The employees were summoned, but were unable to be found. The court of appeals allowed the confessions to be admitted. The insurance company appealed.
