Facts
G.T. Management, Inc. (defendant) managed a dance club. There were frequent fights at the club, and bouncers were employed to break up fights and escort patrons involved in fights out of the club. The bouncers were hired based on their size and used chokeholds to control customers. Michael Gonzalez (plaintiff) went to the club and was injured as a result of a confrontation with the bouncers. Gonzalez alleged that the bouncers pinned his arms when they mistook him for someone who had thrown a bottle, hit him in the face with flashlights, and threw him down the steps at the club entrance. Gonzalez sued G.T. Management on a theory of respondeat superior. The court rendered a verdict in favor of Gonzalez. G.T. Management appealed.
