Facts
Janet and William Gafner (plaintiffs) sued Dr. Cynthia Sammis (defendant) and Down East Community Hospital (the hospital) (defendant) for professional negligence after their daughter suffered injuries from a complication during her birth. The Gafners argued that the court should recognize a cause of action for corporate liability against the hospital for its failure to have a policy mandating consultation with a specialist for high-risk births. The trial court entered summary judgment for the hospital. The Gafners appealed.
