Facts
Timothy Galarnyk (plaintiff) fell in a hotel owned by Hostmark Management, Inc. (defendant) and was injured. Galarnyk sued Hostmark, alleging that his fall was caused by a bathmat in the hotel room that was not properly secured. The district court granted Hostmark summary judgment. Galarnyk appealed, arguing that Hostmark and its insurance company had offered to pay for Galarnyk’s medical bills, thus signifying their liability for the injury.
