Facts
Graciela Gonzalez was killed while working in a Georgia chicken-processing plant when she was struck by a moving part of a machine. The machine had been manufactured in New Jersey by Kason Corporation (defendant), a New Jersey corporation, 13 years before the accident. Samuel Gantes, as representative of Gonzalez’s estate (plaintiff), commenced a product-liability action against Kason in New Jersey state court. The action was filed within New Jersey’s two-year statute of limitations. However, the trial court granted summary judgment in favor of Kason, holding that the action was barred by Georgia’s statute of repose, which barred product-liability actions against manufacturers commenced more than 10 years after the manufacturer sold the product. The appellate division affirmed.
