Facts
Danilo Bobillo was shot and killed in the parking lot of a bar. The personal representative of Bobillo’s estate (plaintiff) sued the bar (defendant) for negligent security on the premises. At trial, over the personal representative’s objection, the trial court permitted the bar to introduce evidence of Bobillo’s bad character to show that his death was caused by that character and not by a lack of security. The bar’s evidence suggested that Bobillo was in a gang, referenced prior criminal conduct of Bobillo and his friends, and permitted testimony that Bobillo frequently got into bar fights. The trial court awarded damages to Bobillo’s estate, but Bobillo’s personal representative appealed.
