Facts
George Garrido (plaintiff) presented a comprehensive advertising campaign to Burger King Corporation (defendant). The presentation included written documents and visual advertising materials. The basis for Garrido’s campaign was: “everywhere you go in America there is a Burger King town.” Garrido never heard back from Burger King after the meeting, but less than one year later Burger King began an advertising campaign called “Burger King Town.” Garrido sued Burger King for misrepresentation and misappropriation, among other things. The trial court granted Burger King summary judgment on the ground that the claims were barred by the Copyright Act. Garrido appealed.
