Facts
Michael Gay (plaintiff) brought this action against Hugh Mooney (defendant), the administrator of the estate of the deceased Hugh Mooney. During the last few years of Mooney’s life, Gay provided board and lodging to Mooney, who was the uncle of Gay’s wife. Gay brought this action in order to recover the value of the services he had provided to Mooney. At trial, Gay proffered evidence that he had provided such services to Mooney with the understanding that Mooney would later devise a house to Gay’s children. The trial court found in favor of Gay.
