Facts
FPL Service Corp. (FPL) (defendant) leased two copiers from General Electric Capital Corp. (GECC) (plaintiff). The rental contract stated that if a copier was damaged, rent payment would continue to accrue until FPL either paid to replace or repair the copier, or paid GECC all of FPL’s then-due and future rental payments. Hurricane Sandy struck, destroying nearly all of FPL’s equipment, including the two rented GECC copiers. FPL stopped making its rental payments, and GECC sued for breach of contract. GECC moved for summary judgment.
