Facts
General Motors Corporation (plaintiff) (General Motors), an American company, owned Opel, a German company. Ignacio Lopez (defendant) worked for General Motors before leaving to work for Volkswagen, a German corporation with a subsidiary, Volkswagen America, located in the United States. General Motors alleged that Lopez took stolen documents to Volkswagen and agreed to give Volkswagen confidential trade secrets. General Motors filed suit in the Eastern District of Michigan in a complaint with four counts, one of which alleged a violation of the Lanham Act. Lopez filed a motion to dismiss as to the Lanham Act count, alleging that the Lanham Act did not incorporate any substantive provision of the Paris Convention and that therefore General Motors’ claims fell outside the scope of the act.
