Facts
General Refractories Company (GRC) (plaintiff) was sued in several lawsuits due to asbestos in its products. GRC sued its insurance company, Travelers Casualty and Surety Company (Travelers) (defendant) for claims related to the underlying lawsuits. GRC planned to present at trial an itemized summary of the settlements it signed to settle the underlying lawsuits. GRC had maintained the summary for years and had provided occasional updates to the summary to Travelers—as its insurance company, prior to litigation—from time to time. Travelers filed a motion in limine seeking to exclude the summary evidence on the ground that GRC had not produced the final summaries that it planned to use at trial.
