Facts
Bacon was planning to go hunting on Douglas Hereford Ranch (Ranch) (defendant), but as he was walking on wooden steps at the Ranch, he stumbled and his rifle went off, killing Barbara Gentry. Gentry’s husband brought a suit against the Ranch, claiming negligence in the maintenance of the steps. Bacon testified at trial that he did not remember what caused him to stumble. The trial court granted the Ranch summary judgment. Gentry appealed.
