Facts
George Basch Co. (plaintiff) manufactured automotive products, as did its competitor, Blue Coral, Inc. Basch sued Blue Coral under the Lanham Act, alleging that Blue Coral had infringed on its trade dress rights by selling products with packaging that was deceptively similar to the packaging of Basch products. A jury found for Basch, and awarded $200,000 in damages, which included an award of Blue Coral’s profits. Blue Coral appealed.
