George v. Great Eastern Food Products, Inc.
New Jersey Supreme Court
207 A.2d 161, 44 N.J. 44 (1965)
- Written by Serena Lipski, JD
Facts
George Geotakes was at work at Great Eastern Food Products, Inc. (Great Eastern) (defendant) when he suffered an attack of dizziness caused by a cardiovascular condition and fell to the ground. Geotakes was injured when his head hit the concrete floor, and he died a few weeks later. Geotakes’s dependents (plaintiffs) filed a workers’-compensation claim for the period between injury and death as well as for death benefits. The Division of Workmen’s Compensation denied the claim. Geotakes’s dependents appealed, and the county court affirmed, holding that injuries due to an idiopathic injury are never compensable. The appellate court affirmed the administrative decision. Geotakes’s dependents appealed.
