Facts
Georgia Aquarium, Inc. (Aquarium) (plaintiff) sought a permit to import 18 beluga whales from Russia for public display. The National Marine Fisheries Service (service), acting under the Marine Mammal Protection Act, denied the permit because the service felt that Aquarium failed to show that the importation of the whales was consistent with the purposes of the act. Aquarium sued, arguing that the service’s permit denial was arbitrary, capricious, and not in accordance with the law. Both sides moved for summary judgement.
