Facts
The State of Georgia (plaintiff) indicted the defendants, who were White, for assault and battery against an African American couple. Georgia filed a motion with the trial court requesting that the court prohibit the defendants from using peremptory jury challenges in a racially discriminatory manner. The trial court denied the motion. Georgia appealed, and the Georgia Supreme Court affirmed. Georgia petitioned the United States Supreme Court for review.
