Facts
Patricia Geressy (plaintiff) was one of three people who suffered repetitive injuries from using a model of a computer keyboard made by Digital Equipment Corporation (defendant). Geressy sued Digital Equipment for failure to warn and negligent design. A jury awarded Geressy $3,490,000 for pain and suffering. Both parties provided the court with statistical analyses of the amount of the jury verdict. Digital Equipment argued that the amount of the jury verdict was a material deviation, and Geressy argued that the amount of the jury verdict was not a material deviation.
