Facts
Bartco Petroleum Corporation (Bartco) (defendant) infringed the registered trademark of Getty Petroleum Corporation (Getty) (plaintiff). The district court determined that § 35 of the Lanham Act authorized the jury to award punitive damages against Bartco for willful infringement of Getty’s mark. Bartco appealed.
