Facts
Ghana Supply Commission (GSC) (plaintiff) sued New England Power Company (NEPCO) (defendant) to recover payment for oil that GSC had sold to NEPCO’s supplier. GSC brought the lawsuit on behalf of the Republic of Ghana. Approximately one month before the suit was filed, the National Redemption Council of the Republic of Ghana formed a committee to investigate the outstanding payments. During discovery in GSC’s lawsuit, NEPCO requested certain documents and testimony produced for the committee. The Republic of Ghana asserted executive privilege and refused to produce the requested documents.
