Facts
Decedent’s Massachusetts administratrix (plaintiff) filed a death claim in a New Hampshire state court against New Hampshire theatre owners (defendants) for the wrongful death of the decedent, who died from injuries sustained in a fire at the theatre. The theatre owners contested the claim on the grounds that the Massachusetts administratrix was not the deceased’s administrator within the meaning of New Hampshire’s wrongful-death statute because the Massachusetts administratrix was never appointed under New Hampshire law. The trial court held that the Massachusetts administratrix was not precluded under New Hampshire law from bringing the wrongful-death claim on behalf of the deceased’s beneficiaries. The theatre owners appealed.
