Facts
Pepper (defendant) was riding his horse through town. The horse became frightened, and Pepper lost control of the horse. Pepper warned people nearby to look out for the horse. Despite Pepper’s warnings, Gibbons (plaintiff) did not move out of the way of the horse and was then injured by the horse. Gibbons brought suit against Pepper for trespass, assault, and battery.
